It is incumbent upon a municipality to exercise reasonable care and diligence to keep and maintain its streets and sidewalks in a safe and passable condition for public use and travel. This duty includes the protection from falling objects. However, this is not an absolute duty, the city not being an insurer of safety. Under the facts stated in the opinion, the jury was justified in finding no liability on part of the defendant city for injuries sustained by a pedestrian by the falling of a defective cornice.
